Enacts the Uniform adult guardianship and protective proceedings jurisdiction act and Uniform guardianship, conservatorship and other protective arrangements act.
Bill amends as well as repeals multiple provisions under Kansas statutes annotated.
Uniform Adult Guardianship
Sets procedures for guardianship or protective proceedings, hearings and testimony.
Gives framework to determine state jurisdiction when multiple states are involved in adult guardianship and conservatorship cases, and allows guardianship transfers.
Updates rules to emphasize less restrictive alternatives and protect the rights of individuals subject to guardianship or conservatorship, procedures for appointments.
Requires guardians and conservators to involve the protected person in decisions.
Also, respects the protected person’s preferences, establish procedures for appointment, monitoring, and termination of guardianships and conservatorships.
Bill requires additional reporting by guardians and conservators, increases court oversight, specifies standards for emergency appointments, alternative arrangements.
