SD LEG reported passage of bill HB 1141 to provide an exception for employers to acquire and distribute opioid antagonists that are available over the counter (OTC).
Amended SD LEG 34-20A-105.1 on opioid antagonist employer dispense immunity.
Bill Provisions
Provided that a licensed health care professional may, directly or by standing order, dispense or distribute an opioid antagonist that requires a prescription to an employer.
Employer may acquire and make available on the employer's premises an opioid antagonist that requires a prescription if the employer meet provided conditions.
Must develop protocol for transport, storage, maintenance, location of antagonist.
Provided training and instruction, developed by Department of Health, to employees or personnel authorized to administer an opioid antagonist on the employer's premises.
Further must prominently post instructions on the administration of opioid antagonist and post-administration protocol, if the employer makes it accessible to the public.
Requirements do not apply to opioid antagonist that are available over the counter.
Employers permitted to acquire and distribute OTC opioid antagonist to any person.
