Prohibits enforcing of occupational safety and health administrative regulation that has not been promulgated by or is more stringent than corresponding federal provision.
Allows Franklin Circuit Court to award actual expenses against the Department of Workplace Standards, allows employee representative be present during an inspection.
Only current employees or representatives of current employees to request inspection.
Commissioner's representative allowed to consult with employees in certain situations.
Requires alleged violation date be included in the notice and the employee's representative be notified, sets time limits for filing a complaint and issuing a citation.
Each citation required to include reference to provision of rule or regulation violated, citation or notice for any de minimis violation to be issued promptly after inspection.
Also prohibits the issuance of a citation more than six months after the violation.
