NOR GVT issued bill Prop. 118 L (2023–2024) Amendments to the Competition Act (introduction of market investigations), to offer NOR CMP a new intervention tool.
Main Points
The new tool, market investigation, will allow the NOR CMP to intervene in markets even if there is no breach of the Competition Act, in order to fight rising food prices.
The bill, sent to NOR PRL, allows NOR CMP to introduce targeted measures at an earlier time; for use in the grocery industry and in markets with limited competition
Before the supervisory authority starts a market investigation, they must conduct an open hearing and have a dialogue with affected parties, due to tool's invasive nature.
There must therefore be a high threshold for introducing proportionate measures.
Measures can be behavioral or structural; stricter conditions for imposing structural measures, e.g. the sale of a business; market players can propose remedial measures.
Dec. 2024 Legislative Resolution Published
On Dec. 12, 2024, NOR PRL issued legislative resolution 11 (2024-2025) on amendments to the Competition Act (introduction of market investigation).
Amendments to Act 12 of Mar. 5, 2004 on Competition between Enterprises and the Control of Mergers; the King may issue exemption regs for some markets/industries.
