KNY LEG enacted bill HB 201 which amends Kentucky revised statutes,KNY LEG 514.070 relating to theft by failure to make required disposition of property.
Aims to include the conduct of a person holding another person's property longer than the allowable rental agreements and depriving the owner of its use for future rentals.
Bill Provisions
A person is guilty of foregoing theft of property received when he or she obtains property upon agreement to make specified payment, with no option to purchase.
If they fail to return personal property within 5 days after receiving notice sent by the merchant/lessor demanding return, and intentionally holds onto the personal property.
If the personal property is returned, any monetary loss from depriving the owner of future use of the property for future rentals may only be pursued as a civil matter.
